In consideration of being permitted to participate in a motorcycle photo opportunity (the “Activity”) offered by ThreatLocker, Inc. and its affiliates (collectively, “ThreatLocker”), I acknowledge and agree as follows:
- Assumption of Risk I understand that the motorcycle is stationary and intended solely for photographs. Approaching, mounting, sitting on, posing with, and dismounting it may involve risks, including slipping, falling, loss of balance, contact with parts of the motorcycle, property damage, and bodily injury. I voluntarily assume these risks, including those arising from ordinary negligence, to the fullest extent permitted by law.
- Release of Liability To the fullest extent permitted by applicable law, I release and discharge ThreatLocker and its affiliates, officers, directors, employees, agents, event partners, sponsors, and representatives from claims, losses, damages, and liabilities arising out of or relating to my participation in the Activity, including personal injury or property damage sustained while mounting, sitting on, posing with, or dismounting the motorcycle, including claims based on their ordinary negligence. This release does not extend to gross negligence, willful misconduct, or liability that applicable law prohibits releasing.
- Participant Safety Obligations I will follow event personnel instructions; mount and dismount carefully; refrain from starting, moving, or operating the motorcycle or manipulating its controls; and discontinue participation if I feel unsafe. I understand I may decline to participate at any time.
- Photography and Publicity Release I grant ThreatLocker and its affiliates, successors, assigns, and authorized representatives a perpetual, worldwide, royalty-free right to photograph or record me during the Activity and to use, reproduce, edit, publish, display, distribute, and otherwise exploit my image, likeness, name, voice, and resulting photographs or recordings in advertising, marketing, promotional, website, social-media, and other business materials, in any medium, without further approval, notice, or compensation. I waive inspection and approval rights and release claims arising from authorized uses, to the extent permitted by law.
- Acknowledgment I am at least 18 years old, have read and understand this document, and sign voluntarily. I understand that this document affects legal rights, including my ability to bring certain injury claims. If any provision is unenforceable, the remaining provisions shall remain effective to the extent permitted by law.
